Terms of Service

The terms that govern the sale and use of our digital guides.

These Terms of Service (the "Terms") govern the sale of our digital guides and the use of this website. Please read them before placing an order. By completing a purchase you confirm that you have read and accepted these Terms.

1. Seller

The website mischkastudio.com and the digital guides sold through it are operated by:

2. Definitions

  • "Seller", "we", "us" means Mischka Studio, identified above.
  • "Customer", "you" means any person who places an order through the website.
  • "Consumer" means a natural person who enters into the contract outside their trade, business, craft or profession. A "business customer" is a legal person, or a natural person acting for business purposes.
  • "Digital guide" or "product" means an interactive marketing guide accessed through a customer account, together with its downloadable resources. It is not supplied on a tangible medium.
  • "Durable medium" means any means, such as email, that lets you store information addressed to you and reproduce it unchanged.

3. Products

We sell interactive digital guides available in a customer account after payment confirmation. Each product page states its main characteristics, content, access tiers and final price. Files included with a guide are downloaded separately from the protected customer area.

The guides provide general information and educational content. They are not individual professional, legal, financial or tax advice.

4. Prices

Prices are shown in euro (EUR) on each product page. The total amount payable is shown before you confirm the order. We may change prices at any time, but the price that applies to your order is the one displayed at the moment you place it.

The Seller is not registered in the VAT system (small-taxpayer special procedure), so VAT is not charged and the displayed price is the final price.

5. Ordering and payment

You submit an order by selecting a guide and access tier, completing the profile used for the proforma invoice, and activating a button clearly labelled as an order with an obligation to pay. Payment is made by bank transfer. We email you a proforma invoice with our IBAN, amount and payment reference.

Bank account: Zagrebacka banka, IBAN HR8123600001103062542. If we do not record your payment within 14 days, the proforma invoice and order may be cancelled. Card payment is currently unavailable.

Your order is a binding offer. The contract is concluded when we confirm receipt of your payment. We then email a contract confirmation stating the guide, tier, price, access method and withdrawal information.

6. Delivery and access

The guide is delivered electronically. After confirming payment, we activate online access through your customer account without undue delay. Included files are downloaded from the protected customer area. No physical goods are shipped and there are no delivery costs. If access is missing after payment confirmation, contact info@mischkastudio.com.

7. Right of withdrawal

If you are a consumer, you may withdraw from a distance contract without giving a reason within 14 days of concluding the contract, which is when we confirm receipt of payment.

How to submit a statement

During the withdrawal period, the “Contract withdrawal” function is clearly available from your customer-account menu and confirmed-purchase page. After checking your name, contract reference and email address, submit the statement with the “Confirm contract withdrawal” button. We promptly email an acknowledgement containing the statement text and its submission date and time. You may also send any other unequivocal statement to info@mischkastudio.com.

You retain this withdrawal right for 14 days even after we activate online guide access. Once we receive the statement, we stop access immediately and refund the amount received without undue delay and no later than 14 days. If you withdraw only from a Professional upgrade, we restore Standard access and refund the upgrade amount.

The statutory withdrawal right applies to consumers. Business customers are not entitled to it by law, but Mischka Studio currently offers the same 14-day online function to all paid-guide customers.

8. Licence and permitted use

When you buy a guide you receive a limited, non-exclusive, non-transferable licence to use it for your own personal or internal business purposes. The content remains our intellectual property.

You may not:

  • copy, resell, sublicense, rent or otherwise commercialise the guide or any substantial part of it;
  • publish, share, upload or distribute the guide to third parties, publicly or privately;
  • remove or alter any copyright notice, author attribution or watermark.

9. Complaints and conformity

If a digital guide does not match its description or is not fit for its purpose, you are entitled to the statutory remedies for non-conformity of digital content, independently of the right of withdrawal.

You may submit a written complaint about the product or the sale by email, quoting your order reference. We will confirm receipt without delay.

We will reply to your complaint in writing within 15 days of receiving it.

10. Liability

The guides provide general information and you apply them at your own discretion. To the extent permitted by law, we are not liable for indirect or consequential loss, lost profit, or business decisions taken on the basis of a guide. Nothing in these Terms limits liability that cannot be limited under Croatian law, including a consumer's mandatory rights and liability for intent or gross negligence. For business customers, our total liability for any claim is limited to the amount paid for the relevant product.

11. Governing law and disputes

These Terms are governed by Croatian law. We aim to resolve any dispute amicably, so please contact us first at info@mischkastudio.com.

If a dispute cannot be resolved directly, a consumer may bring it before the competent court or use out-of-court alternative dispute resolution (ADR) before a notified Croatian body, such as the mediation body of the Croatian Chamber of Trades and Crafts (Hrvatska obrtnicka komora). Note: the EU Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025 and is no longer available.

12. Changes to these Terms

We may amend these Terms. The version in force at the time you place an order applies to that order. We publish the current Terms on this page with the date of the last update.
